These Terms of Service ("Terms") govern your access to and use of TheOfficial App website, applications, and services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.

2. Eligibility and Account Responsibilities

• You must provide accurate account information and keep it updated.
• You are responsible for account credentials, activities, and lawful use of your account.
• You must not use the Services for fraud, abuse, malware, unlawful content, or IP infringement.

3. TheOfficial Link-in-Bio Service

TheOfficial provides public profile pages and link management tools. Content you publish may be publicly visible. You are responsible for the content and destinations you post.

4. Usernames and Freeze Policy

Usernames are limited, unique identifiers. If you cancel your account or your paid plan is cancelled and your profile is no longer active, your username will be placed in a freeze state for 30 days from the effective cancellation date.

During this 30-day freeze period, the username is not available for public registration. After the freeze period ends, the username may be released and made available to other users on a first-come, first-served basis.

5. Subscriptions, Billing, Cancellation, and Refunds

• Paid plans are offered on monthly and annual billing cycles and are billed in advance.
• Unless otherwise stated, paid subscriptions auto-renew until cancelled.
• You may request a refund within 7 calendar days from the payment date for annual plan charges, and within 5 calendar days from the payment date for monthly plan charges. Eligible requests within these windows receive a refund to the original payment method.
• Refund requests received after these timelines are generally non-refundable, except where required by applicable law.
• Cancellation stops future renewals. Access to paid features continues until the end of the current paid period unless we state otherwise in writing.

6. Intellectual Property

We retain all rights in the Services, platform software, branding, and documentation. You retain rights in your content, and grant us a limited license to host, process, display, and distribute your content as needed to operate the Services.

7. Third-Party Services

The Services may rely on third-party providers (such as payment processors, hosting, authentication, and communication tools). Your use of those third-party services may be subject to their terms and policies.

8. Suspension and Termination

We may suspend or terminate access where needed to protect platform security, comply with law, or enforce these Terms. We may remove content that violates law or these Terms.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the extent permitted by applicable law.

10. Limitation of Liability

To the maximum extent permitted by law, Blackwell Corporation Private Limited will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill arising from use of the Services.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, courts in Chennai, Tamil Nadu, India shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.

12. Changes to Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Services after updates means you accept the revised Terms.
